Appeal Process |
| Purpose: |
The
State Fair appeal process provides a vehicle to respond to 4-H member
concerns relating to the Minnesota State Fair 4-H rules/decisions.
This process provides a means for members/parents/gaurdians concerns
to be heard. |
What
may be
appealed: |
Issues
relating to the State Fair may be appealed including eligibility, auction
eligibility, deadline violations, rule violations, etc |
| Who
makes the ruling: |
The
State Fair 4-H Appeal Committee will consist of 5 members, chosen by
the State Fair 4-H Superintendent. The committee make-up may vary
depending on the appeal. |
Process
for filing
an appeal: |
- Appeals
relating to deadline violations or similar infractions prior
to the fair must be filed at the Center for 4-H Youth Development,
200 Oak Street SE-Suite 270B, Minneapolis MN 55455, Attn:
Brad Rugg, phone 1.800.444.4238, fax 612.624.6905 OR the State Fair
4-H Livestock Office in writing on the appropriate appeal form listing
the reasons for the appeal.
- All
appeals against a rule violation, judges decision or a complaint
against an individual or county (things which occurred at the
fair) must be filed at the 4-H Livestock Office in the cattle
barn on the State Fairgrounds in St. Paul OR at the Center for 4-H
Youth Development, 200 Oak Street SE-Suite 270B, Minneapolis
MN 55455, Attn: Brad Rugg, phone 1.800.444.4238 or fax 612.624.6905
in writing on the appropriate appeal form listing the reasons for
the appeal.
- All
appeals must be signed by the person(s) filing the complaint.
(There is no limit as to the number of individuals who can sign
an appeal.)
- All
appeals against a county, individual, or animal at the State Fair
must be filed within 24 hours of completion of the species show
or judging, otherwise the original decision/ruling automatically
stands.
- If
an appeal has been properly filed, the 4-H State Fair Superintendant
will schedule a hearing with the State Fair 4-H Appeal Committee.
- The
appeal form must be submitted with $100 (cash or money order only).
The money will be returned only if the decision is ruled in favor
of the peron(s) filing the appeal.

| At
the Appeal Hearing: |
- Only
those individuals who have signed the appeal, those indicated on
the appeal (in addition to these individuals parents/guardians),
and those with knowledge concerning the appeal will be asked to
speak at the hearing. 4-H members are strongly encouraged
to voice their own views at the appeal hearing. Parents/guardians
are encouraged to allow the 4-H members to represent themselves.
- Participants
in the appeal hearing are expected to act in a civil manner.
Use of profanity or other inappropriate behavior by either party
will not be accepted and may result in terminating the hearing.
- The
individual(s) filing the appeal will have the opportunity to express
their view to the committee.
- If
the appeal is against another party, they will be invited to attend
by the 4-H Superintendent to provide an opporitunity to defend their
position.
- All
parties are expected to provide appropriate documentation/evidence
upon request. If individuals are uncooperative and refuse
to provide/bring requested information, the Appeal Committee may
terminate the appeal process or the appeal may not be determined
in the favor of the uncooperative party.
- After
all information is presented, the committee will meet privately
to discuss the issue and come to a decision. Decisions will
be based on a majority rule. Committee members are expected
to keep discussions confidential.
- Once
a decision is determined the two parties will be notified of the
decisions of the committee. Decisions made by the committee
will be final.

| What
is the role of the State Fair 4-H Superintendent: |
The
State Fair Superintendent will appoint members to serve on the State
Fair Appeal Committee. The State Fair 4-H Superintendent will
attend all meetings at which appeals are heard to ensure that all sides
are heard and all options/alternatives are considered. The State
Fair 4-H superintendent will facilitate the meeting but will
not have a vote in the final decision. |
